All proprietary content on this website and within our Mastermind Roadmap - including text, graphics, logos, video content, and software frameworks - is the property of Steve Gaston or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or white-label any proprietary content without prior written consent from Steve Gaston.

Our use of your personal data and the data of your customers is governed by our Privacy Policy. When we provide you with a sub-account within our CRM ecosystem, you remain the "Data Controller" of all information uploaded to that account.

8. PLATFORM INFRASTRUCTURE & SECURITY RESPONSIBILITY

8.1. Platform Infrastructure: The Client acknowledges that Headsmart Global Agency utilizes GoHighLevel as its core technology infrastructure. The Agency is a service provider and administrator of this platform, not the developer. Consequently, the Agency cannot be held responsible for inherent software bugs, glitches, platform-wide outages, security vulnerabilities within the GoHighLevel software itself, or data loss caused by underlying hosting providers (e.g., Google Cloud, AWS).

8.2. Security and Access Control: The Agency agrees to maintain professional administrative standards to secure the Client’s data within the platform. Our responsibility is limited to restricting sub-account access to authorized users only, implementing granular user permissions, and enforcing Agency-level security protocols.

8.3. Legal Compliance & Data Integrity: While the Agency provides the infrastructure and builds the workflows, the Client is responsible for ensuring that their use of the platform complies with all local and international laws (including, but not limited to, GDPR and CCPA). The Agency is not responsible for legal issues arising from the Client’s independent data collection methods or business practices.

8.4. Indemnification: The Client agrees to indemnify and hold Headsmart Global Agency harmless from any legal claims, damages, or expenses arising from the Client's breach of third-party confidentiality agreements or violations of data protection laws while using the platform.

9. TERMINATION

We reserve the right to terminate or suspend your access to our services, Mastermind groups, or software tiers at our sole discretion, without notice, for conduct that we believe violates these Terms and Conditions, disrupts the ecosystem, or is harmful to other users.

10. SMS TERMS AND CONDITIONS (A2P 10DLC COMPLIANCE)
